1. General information

These terms of purchase apply to the purchase of goods from Enedria AS over the internet. The terms of purchase were last updated on 10. June 2021, and will apply to all existing and new agreements

and is hereinafter referred to as “Enedria AS”, “we”, “us” or “seller”.
The buyer is the person specified as the buyer in the order regardless of the purchase channel, and is hereinafter referred to as “you”, “you” or “the customer”. You must be at least 18 years old to become a customer of Enedria AS.

3. Subscription

Enedria sells the products on an ongoing subscription basis. Delivery is normally made after 14 days and thereafter according to the chosen delivery frequency, without any purchase obligation or binding period. The subscription can be canceled on an ongoing basis. Upon termination, the subscription will be terminated immediately with effect from the next mailing. You can contact customer service at any time to pause, change or cancel your subscription. Changes to products, delivery form and delivery frequency may occur. Notification of changes will be sent in good time before they come into force. Minor changes, such as changes in packaging, will not be notified beyond information on our websites. Subscriptions may be refused for good cause, such as attempted fraud, lack of creditworthiness, etc.

4. Prices

Our prices are stated in Norwegian kroner and include VAT. The price of the product may vary depending on the sales channel, distribution and special offers. Prices are valid until changed. Notification of price changes will be sent in good time before the changes take effect. Introductory offers cannot be unfairly exploited through frequent and repetitive subscription subscriptions/cancellations as they are primarily aimed at new customers. Postage and handling charges will be added to each shipment according to the applicable rates, unless otherwise agreed.

5. Delivery

We send our shipments at the agreed delivery frequency with Posten. If the delivery time does not follow from the ordering solution, we shall deliver the goods without undue delay and no later than within 30 days of your order.
We issue a written invoice that serves as an order confirmation and is enclosed with all shipments. In the case of special offers, larger or multiple orders, the order may need to be picked up at the post office due to size and weight.
Delivery is considered to have taken place when you, or your representative, have taken possession of the goods.
In the event of late delivery, you may, depending on the circumstances, withhold the purchase price, demand delivery, compensation or terminate the agreement.

6. Payment

You pay when ordering online with Visa/MasterCard.
Cards are charged when ordering.

7. Right of withdrawal

You are protected by the Cancellation Act and have a 14-day unconditional right of withdrawal from the day you receive the item on your first shipment. The deadline includes all calendar days. If the deadline ends on a Saturday, public holiday or holiday, the deadline is extended to the next working day. The deadline is considered to have been met if notification is sent before the deadline expires.
The right of withdrawal means that you have the right to cancel the purchase of an unopened product and return the item. In order for the right of withdrawal to be exercised, the product must therefore be returned to us in the same quantity and condition as you received it. If the value of the product is reduced more than necessary to determine the nature, characteristics and function of the product, you must cover this loss of value. Unless otherwise agreed, you shall cover the direct costs of returning the goods.

If you exercise your right of withdrawal, we will refund the purchase price without undue delay, and no later than 14 days after we receive notification from you. We have the right to withhold payment until we have received the returned goods or until you have provided documentation that the goods have been sent.

8. Reclamation

If the delivered goods are defective, you may, depending on the circumstances, demand correction of the defect, redelivery, a price reduction, compensation or termination of the contract. If there is a defect in the goods, you must notify the seller within a reasonable time after the defect was discovered or should have been discovered that you wish to invoke the defect. You have always made a timely complaint if it is made within 2 months of the defect being discovered. The right of complaint is limited to complaints within the product’s expiry date as stated on the packaging, and no later than 2 years after you received the product. In the event of a late complaint, you lose the right to claim the defect. The right of complaint applies in addition to the right of withdrawal. In the event of complaints, faults and defects, you will be reimbursed for any shipping costs. We will make the refund using the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise with us.

9. The seller's rights in the event of default by the customer

If you do not pay or fulfill the other obligations under the agreement or the law, and this is not due to the seller or circumstances on the seller’s part, we may, in accordance with the rules in Chapter 9 of the Consumer Purchases Act, depending on the circumstances, retain the goods, demand performance of the agreement, demand termination of the agreement and claim compensation from you. We may, depending on the circumstances, charge interest on late payment and collection fees, and if you fail to collect unpaid goods, the seller may charge you a fee. The fee shall cover a maximum of the seller’s actual expenses for delivering the goods to you.

10. Personal data

In order to execute this agreement, the seller will process certain personal data that can be linked to you (e.g. name and address). If you withdraw from this agreement, we will refund all payments we have received from you, including the delivery costs (with the exception of additional costs resulting from you having chosen a different type of delivery than the cheapest type of standard delivery we offer), without undue delay and in any event no later than 14 days after the day we receive notification of your decision to withdraw from this agreement.

12. Reservations and limitations of liability

Seller reserves the right to transfer its rights and obligations under this Agreement to another party. Reservations are also made for breakdowns, printing errors, incorrect prices, changes in value added tax and other taxes or delivery problems due to circumstances beyond our control. Any offers are valid while stocks last (as stated in connection with the individual campaign).
The seller does not take responsibility for incorrect use of products and recommends that you follow the recommended dosage on the package.

13. Change in the terms of purchase

These terms of purchase are subject to change in the event of special needs and/or changes in legislation, orders or recommendations. You will be notified of any changes to the terms and conditions. Such notice shall be given no later than 1 month before the changes come into force. If, based on the changed terms and conditions, you wish to terminate the agreement, you are free to do so. Failure to terminate the agreement after changes to the contract terms means that you accept the updated contract terms. New terms will be announced on our website in combination with the distribution of the new terms.

14. Conflict resolution

If you wish to complain about your purchase, please contact customer service. Complaints should be directed to the seller within a reasonable time, cf. points 7 and 8. The parties shall attempt to resolve any dispute amicably. If this is unsuccessful, you can contact the Consumer Council for mediation. The Consumer Council is available by phone on 23 400 500 or at www.forbrukerradet.no. If mediation is unsuccessful, you or the seller can take the matter to court. The agreement is governed by Norwegian law. The legal venue is Oslo District Court.
